        Glossary

        User: Internet user accessing and using the aforementioned site.

        Personal information: “information that allows, in any form whatsoever, directly or indirectly, the identification of the individuals to whom it applies” (Article 4 of Law No. 78-17 of January 6, 1978).

         

        Terms and Conditions of Use

        Use of the site implies full acceptance of the terms and conditions set out below. These terms of use may be modified or supplemented at any time, and users of the site are therefore invited to consult them regularly.

        The site is normally accessible to users at all times. An interruption for technical maintenance may however be decided by the owner, who will then strive to inform users in advance of the dates and times of the intervention.

        The site is updated regularly by the owner. Similarly, the legal notices may be modified at any time; they are nevertheless binding on the user, who is invited to refer to them as often as possible to be informed.

        The site aims to provide information concerning all activities of the company.

        The owner strives to provide information on the site that is as accurate as possible. However, they cannot be held responsible for omissions, inaccuracies, or deficiencies in the update process, whether caused by themselves or third-party partners who provide the information.

        All information on the site is given for guidance purposes and is subject to change. Furthermore, the information on the site is not exhaustive and is subject to changes made since it was put online.

         

        Technical Limitations

        The site uses JavaScript technology.

        The website cannot be held responsible for any material damage resulting from the use of the site. Moreover, the user agrees to access the site using recent equipment, free of viruses and with an up-to-date modern browser.

         

        Intellectual Property and Infringements

        The owner holds the intellectual property rights or usage rights for all elements accessible on the site, including text, images, graphics, logos, icons, sounds, and software.

        Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the site, regardless of the means or process used, is prohibited without prior written authorization from the owner.

        Any unauthorized use of the site or of any element it contains will be considered an infringement and prosecuted in accordance with Articles L.335-2 and following of the Intellectual Property Code.

         

        Limitation of Liability

        The owner cannot be held liable for direct or indirect damage caused to the user's equipment when accessing the site www.domain.com, resulting either from the use of equipment not meeting the specifications indicated in point 4, or from the occurrence of a bug or incompatibility.

        The owner shall also not be held liable for indirect damages (such as loss of market or loss of opportunity) resulting from the use of the site.

        Interactive spaces (possibility to ask questions in the contact area) are available to users. The owner reserves the right to remove, without prior notice, any content posted in this space that violates applicable French legislation, particularly provisions relating to data protection. If necessary, the owner also reserves the right to invoke the civil and/or criminal liability of the user, especially in case of messages that are racist, offensive, defamatory, or pornographic, regardless of the medium used (text, photographs, etc.).

         

        Personal Data Management

        In France, personal data is particularly protected by Law No. 78-87 of January 6, 1978, Law No. 2004-801 of August 6, 2004, Article L. 226-13 of the Penal Code and the European Directive of October 24, 1995.

        When using the site, the following may be collected: the URL of the links through which the user accessed the site, the user's Internet provider, and the user's Internet Protocol (IP) address.

        In any event, HERMINE AUTO only collects personal information about the user for the need of certain services offered by the site. The user provides this information knowingly, especially when entering it themselves. In this case, the user is informed whether or not it is mandatory to provide this information.

        In accordance with Articles 38 and following of Law 78-17 of January 6, 1978 on data processing, files, and freedoms, any user has the right to access, rectify, and oppose personal data concerning them, by making a written and signed request, accompanied by a copy of an identity document with the holder's signature, specifying the address to which the response should be sent.

        No personal information of the site user is published without their knowledge, exchanged, transferred, assigned, or sold on any medium to third parties. Only the hypothetical purchase of the site and its rights would allow the transmission of such information to the potential buyer, who would in turn be bound by the same obligation of data retention and modification towards the site user.

        The site is not declared to the CNIL because it does not collect personal data.

        The databases are protected by the provisions of the Law of July 1, 1998, transposing Directive 96/9 of March 11, 1996 on the legal protection of databases.

         

        Hyperlinks and Cookies

        The site contains a number of hyperlinks to other sites, set up with the permission of the owner. However, the owner has no possibility to check the content of the sites thus visited and will not assume any responsibility as a result.

        Browsing the site may cause cookies to be installed on the user's computer. A cookie is a small file that does not allow the identification of the user but records information relating to the browsing of a computer on a site. The data obtained is intended to facilitate future browsing on the site and also to enable various traffic measurements.

        In Firefox: At the top of the browser window, click the Firefox button, then go to the Options tab. Click the Privacy tab. Set the Retention Rules to: use custom settings for history. Finally, uncheck the box to disable cookies.

        In Safari: Click the menu icon (gear symbol) at the top right of the browser. Select Settings. Click on Show Advanced Settings. In the "Privacy" section, click on Content Settings. In the "Cookies" section, you can block cookies.

        In Chrome: Click the menu icon (three horizontal lines) at the top right of the browser. Select Settings. Click on Show Advanced Settings. In the "Privacy" section, click on Preferences. In the "Privacy" tab, you can block cookies.

         

        Governing Law and Jurisdiction

        Any dispute related to the use of the site is subject to French law. Exclusive jurisdiction is given to the competent courts of Paris.
